Corporate Transparency Act – US Supreme Court Ruling – Injunction Still In Place
The date of this alert is February 4, 2025. Well, the circus continues. In December 2024, the federal government filed an appeal with the U.S. Supreme Court in attempting to stay a nationwide preliminary injunction in the enforcement of the Corporate Transparency Act (the “Act”). The U.S. Supreme Court ruled on January 23, 2025 that the nationwide preliminary injunction put in place by an appellate court should be stayed and the Act should be enforceable during the appeal of the case. BUT, in the beginning of January 2025, a second federal court entered a nationwide preliminary injunction. This second nationwide preliminary injunction is still in place. So, compliance with the Act is stayed while this second preliminary injunction is still in place. What a mess.
